Tenant Exercises His Rights

One of our clients was successful in having his rent deposit returned after taking his Landlord to court. The wording we provided in the Offer to Lease allowed for the whole leasing process to be declared null and void if agreement could not be reached on the Lease. The judge agreed that once an Offer is signed, the wording in it stands, something most businesses do not understand. The point was made that any document can be changed prior to signing through the negotiation process.

BUSINESS AS USUAL

We assisted both a new Landlord and a new Tenant in developing a Lease for a strip plaza. The Lease had to reflect some unique situations with regards to the right tenant mix and providing wording to recover sufficient additional rent for the Landlord, while at the same time explaining the whole lease process to the 6000 square foot tenant.
